Terms of Service

These Terms are an agreement between you and Inkwrite (“Inkwrite,” “we,” “us”). By creating an account or using Inkwrite, you agree to them. Please read them carefully — they include important limits on our liability and how disputes are resolved.

1Who we are, and what this covers

Inkwrite is a writing application that helps novelists draft, organise, and revise their work, with optional AI assistance. These Terms cover your use of the Inkwrite website, applications, and related services (together, the “Service”). If you do not agree with these Terms, please do not use the Service.

2Eligibility and your account

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. You are responsible for the accuracy of the information you provide and for keeping your account secure. Authentication is handled by our provider, Clerk; you are responsible for activity that occurs under your account.

3Your manuscripts and content

Your work is yours.You retain all rights, title, and interest in the manuscripts, notes, characters, and other content you create or upload (“Your Content”). We do not claim ownership of Your Content.

You grant us only the limited licence we need to operate the Service for you: to store, copy, transmit, display, and process Your Content so that we can provide features such as cloud sync across your devices, backup, and the AI assistance you request. This licence exists only to run the Service for you and ends when you delete the content or your account, except for residual backups that are deleted in the ordinary course (see our Privacy Policy).

We do not train models on your writing. We do not use Your Content to train our own models, and we do not sell Your Content. To provide AI features, portions of Your Content are sent to third-party AI providers (see Section 4 and the Privacy Policy), whose handling of that content is governed by their own terms.

4AI features and generated content

When you use an AI feature, the relevant parts of your manuscript and your instructions are sent to our third-party AI provider(s), which return generated text (“Output”). As between you and us, you own the Output you obtain through your account, to the extent permitted by law and by the AI providers’ terms.

  • Output may be wrong. AI can produce inaccurate, biased, or misleading text. You are responsible for reviewing and editing any Output before relying on or publishing it.
  • Output may not be unique. Similar prompts can produce similar text for different users. We do not guarantee that Output is original or free of third-party rights.
  • You are responsible for your use of Output, including ensuring it does not infringe others’ rights or violate any law.

5Acceptable use

You agree not to use the Service to:

  • break the law, or infringe the intellectual-property or privacy rights of others;
  • generate or store content that sexually exploits minors, or that is unlawful, harassing, or designed to harm others;
  • attempt to disrupt, reverse-engineer, scrape, overload, or circumvent the limits or security of the Service (including the AI usage limits);
  • resell or provide the Service to third parties except as expressly permitted.

You must also comply with the acceptable-use and content policies of our AI providers, which may prohibit additional categories of content.

6Plans, credits, and billing

Writing, local storage, cloud sync, and your World — the story bible Inkwrite keeps — are available at no charge. AI assistance is metered in credits. We currently offer a free tier with a monthly credit allowance and a paid Inkwrite Pro subscription with a larger allowance, at the prices shown on our pricing page.

  • Renewal. Paid subscriptions renew automatically each billing period until cancelled. Payments are processed by Stripe through Clerk Billing; by subscribing you authorise recurring charges to your payment method.
  • Credits. Monthly credits refresh at the start of each period and do not roll over. Credits have no cash value, are not transferable, and cannot be redeemed for money except where required by law.
  • Price changes. We may change prices or credit allowances. We will give you reasonable advance notice, and changes take effect at your next renewal. Promotional rates (such as launch bonuses) are temporary and may end.
  • Taxes. Prices may exclude applicable taxes, which you are responsible for.

7Cancellation and refunds

You can cancel your subscription at any time from your account; cancellation takes effect at the end of the current billing period, and you keep Pro access until then. Except where required by law (for example, statutory withdrawal rights in some jurisdictions), payments are non-refundable and we do not provide refunds or credits for partial periods or unused credits. If you stop paying, your account reverts to the free tier — you keep your manuscripts.

8Third-party services

The Service relies on third parties to function, including Clerk (accounts), Neon (database), Vercel (hosting), Stripe (payments), and our AI providers. Your use of the Service is also subject to their terms, and we are not responsible for their acts or omissions. A current list is in our Privacy Policy.

9Our intellectual property

The Service itself — including the Inkwrite name, software, design, and content we provide (but excluding Your Content and Output) — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

10Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required to protect the Service or other users, or if required by law. We will give notice where reasonable. On termination, the licences in Section 3 end and you should export any content you wish to keep; you may export your manuscripts at any time.

11Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that AI Output will be accurate or suitable, or that data will never be lost. You are responsible for keeping your own backups of important work.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified, including any rights you may have under the Australian Consumer Law.

12Limitation of liability

To the fullest extent permitted by law, Inkwrite and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or manuscripts. Our total liability for any claim arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or AUD 75. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

13Indemnification

You agree to indemnify and hold harmless Inkwrite from claims, damages, and reasonable expenses arising out of Your Content, your use of the Service, or your breach of these Terms, except to the extent caused by us.

14Changes to the Service and these Terms

We may modify the Service and update these Terms. If we make material changes, we will take reasonable steps to notify you (for example, by updating the date above or by email). Continuing to use the Service after changes take effect means you accept the updated Terms.

15Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules, and the courts located there will have jurisdiction, except where mandatory consumer- protection law in your country of residence provides otherwise. Nothing here deprives you of the protection of mandatory provisions of your local law.
